The Nagoya Protocol

The Nagoya protocol entered into force the 12th October 2014. It governs Access to Genetic Resources and the Fair and Equitable Sharing of Benefits arising from their utilisation (ABS).

The use of Genetic Resources (GRs) is regulated by European legislation as well as the national laws of each country of origin.

Are You Using or Planning to Use a Genetic Resource?

The EU ABS (APA) Regulation applies when a Genetic Resource is used within one of the EU Member States, provided that the resource was obtained after the date of application of the regulation (2014).

What is “Utilisation” under the Nagoya Protocol?

Utilisation refers to conducting research and development on the genetic or biochemical composition of a Genetic Resource, including through biotechnology.

This may include:

  • Laboratory analysis
  • Ingredient development or optimisation
  • Strain selection
  • Efficacy testing or formulation work

Due diligence:

Under the EU ABS Regulation, companies using a Genetic Resource must submit a Due Diligence Declaration, confirming that the resource has been obtained lawfully and in accordance with the provider country’s legislation.
