Since 14 December 2024, the General Product Safety Regulation (GPSR) is fully applicable across the European Union.
From now on, any product sold on the EU market, whether in-store or online, must comply with this regulation. Only a few categories are exempt, such as second-hand goods, food items, and medicinal products.
Most consumer products fall within the scope of the GPSR insofar as their safety is not fully covered by more specific EU legislation. This includes chemicals, which are primarily governed by the CLP Regulation, with the GPSR applying only to residual safety aspects not addressed therein, such as certain risks arising from normal consumer use that are not covered by classification and labelling requirements. Most consumer products fall within the scope of the GPSR insofar as their safety is not fully covered by more specific EU legislation :
- Home fragrances: scented candles, fragrance sprays, linen waters, etc.
- Essential oils
- Detergents
- Biocidal products
- Pet care products
- Cosmetic products
- Chemical or cosmetic toys
- …

If you want to place these products on the EU market, you must comply with the applicable EU safety and regulatory requirements, including the General Product Safety Regulation where applicable.
What Are Your New Responsibilities Under GPSR?
To be legally placed on the European market, your product must meet safety requirements:
- Product safety: Products must be designed and manufactured to ensure user safety.
- Risk assessment: Potential hazards linked to normal or foreseeable use must be identified.
- Traceability: Manufacturers must guarantee full traceability of products and their components.
- Consumer information: Clear warnings, usage instructions, and precautions must be provided.
- Post-market surveillance: Products must be monitored after being placed on the market — with immediate corrective actions if a risk is identified (e.g. recall, consumer communication).
You Must Have an EU-Based Representative
A product cannot be sold in the EU without an economic operator established within the Union.
This applies both to importers and to brands selling directly online from outside the EU.
